By engaging Ansonia Tree Service ("we," "us," or "our") in Ansonia, CT, you ("Client" or "you") agree to these Terms and Conditions.
1. Services
We provide tree care services, including tree removal, trimming, pruning, stump grinding, emergency services, and arborist consultations. Scope, timeline, and pricing will be outlined in a written estimate or contract.
2. Estimates and Payments
- Estimates: Valid for 30 days, based on provided information and site conditions.
- Payments: Due upon completion unless otherwise agreed. We accept cash, checks, and credit cards. Deposits may be required for large projects.
- Late Fees: Overdue payments incur a 1.5% monthly fee; services may be suspended until paid.
- Additional Costs: Unforeseen issues may incur extra charges, communicated in advance.
3. Client Responsibilities
- Access: Provide clear site access; we’re not liable for damage to items left in the work area.
- Permits: You are responsible for permits unless agreed otherwise (assistance available for a fee).
- Property: Mark property lines, utilities, and hazards. We’re not liable for damage to unmarked items.
- Debris: Debris removal is your responsibility unless included in the contract (available for a fee).
4. Safety and Liability
- Safety: You must keep pets, children, and others away from the work area. We follow industry safety standards.
- Liability: We’re not liable for unavoidable property damage if reasonable care is exercised. We carry liability and workers’ compensation insurance.
- Force Majeure: We’re not liable for delays due to weather, disasters, or equipment failure.
5. Cancellations and Rescheduling
- Cancellation: Notify us in writing 48 hours in advance; late cancellations incur a 20% fee of the estimated cost.
- Rescheduling: Within 24 hours may incur a $100 fee, based on crew availability.
6. Warranty
- Workmanship: Services are performed to industry standards. Report issues within 7 days for resolution at no cost (within original scope).
- No Plant Health Guarantee: We don’t guarantee tree or plant health due to external factors.
7. Disputes
Disputes will be resolved through negotiation or mediation in New Haven County, CT. The prevailing party in legal action may recover attorney fees.
8. Termination
We may terminate services for non-compliance (e.g., non-payment, unsafe conditions). You remain liable for completed work.
9. Intellectual Property
Our designs, plans, or recommendations are our property and may not be reproduced without consent.
10. Governing Law
Governed by Connecticut State law. Legal actions must be filed in New Haven County, CT.
